The following definitions apply throughout all legal documents on our websites unless the context requires otherwise.

  • ACL: The Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010 (Cth).
  • APP: Australian Privacy Principle as set out in Schedule 1 to the Privacy Act 1988 (Cth).
  • ABN: Australian Business Number – our ABN is 43 432 414 727.
  • AI / Artificial Intelligence: Any software, model, algorithm, or technology performing tasks that typically require human intelligence, including machine learning, natural language processing, and generative AI.
  • AI Output: Any content, data, image, text, or other material generated or materially assisted by any AI system.
  • Business Day: A day banks are open in Brisbane, Queensland – excludes Saturday, Sunday, and Queensland public holidays.
  • Commercial Licence: A licence to use our digital products for commercial purposes as defined in the Extended Licence Agreement.
  • Consumer Guarantee: A statutory guarantee under the ACL, including guarantees as to acceptable quality, fitness for purpose, and correspondence with description.
  • Customer: A person who purchases, downloads, subscribes to, or otherwise acquires any product or service from us.
  • Digital Product: Any intangible product delivered electronically including software, templates, digital assets, artwork, and AI-generated outputs.
  • eSafety Commissioner: The Australian eSafety Commissioner appointed under the Online Safety Act 2021 (Cth).
  • Force Majeure Event: Any event beyond our reasonable control including acts of God, natural disasters, pandemic, war, terrorism, industrial action, or failure of telecommunications or internet services.
  • GST: Goods and services tax imposed under the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
  • Major Failure: A failure as defined in the ACL that would have prevented a reasonable consumer from purchasing had they known about it.
  • Minor Failure: A failure as defined in the ACL that can be remedied within a reasonable time.
  • Notifiable Data Breach: A data breach as defined in Part IIIC of the Privacy Act 1988 (Cth) that is likely to result in serious harm.
  • OAIC: The Office of the Australian Information Commissioner.
  • Online Safety Act: The Online Safety Act 2021 (Cth).
  • Personal Information: Information or an opinion about an identified individual, or an individual who is reasonably identifiable, as defined in the Privacy Act 1988 (Cth).
  • Privacy Act: The Privacy Act 1988 (Cth) as amended, including by the Privacy and Other Legislation Amendment Act 2024 (Cth).
  • Subscription: A recurring payment arrangement for ongoing access to products, services, or content.
  • Token: Emotional Mail internal digital currency purchased as a gift card and redeemable across ElleMotional sites.
  • We / Us / Our: Brent Bernard trading as Emotional Mail and ElleMotional, ABN 43 432 414 727, Gold Coast, Queensland, Australia.
  • Website: emotionalmail.com and all associated subdomains and pages operated by Emotional Mail.
  • You / Your: Any natural person accessing, browsing, or interacting with our websites.
