Copyright Complaint Procedure

1. Purpose

This Copyright Complaint Procedure sets out the formal process for submitting and responding to copyright infringement claims in relation to content on emotionalmail.com, in accordance with the Copyright Act 1968 (Cth).

2. Submitting a Copyright Complaint

Send a written notice to admin@ellemotional.com – Subject: Copyright Infringement Notice. Your notice must include:

  • Your full name, contact details, and relationship to the copyright owner.
  • A physical or electronic signature.
  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the specific content on our website that you claim infringes your copyright, including the URL.
  • A statement that you have a good faith belief that use of the material is not authorised by the copyright owner, its agent, or the law.
  • A statement that the information in your notice is accurate.

3. Our Response

We will acknowledge receipt within 5 business days. If the notice is valid and complete, we will promptly remove or disable access to the allegedly infringing material and notify the user who posted the material.

4. Counter-Notification

A user whose content has been removed may submit a counter-notification to admin@ellemotional.com – Subject: Copyright Counter-Notification – containing their contact details, identification of the removed material, a statement of good faith belief that the removal was a mistake or misidentification, and consent to the jurisdiction of the Federal Court of Australia.

5. Repeat Infringers

We maintain records of copyright complaints and counter-notifications. Users who are the subject of two or more valid copyright complaints within 12 months may have their accounts permanently terminated.
