The following names, logos, and brand assets are trade marks of Brent Bernard trading as Emotional Mail and ElleMotional, and may be registered or unregistered trade marks protected under the Trade Marks Act 1995 (Cth) and applicable common law: EMOTIONAL MAIL, ELLEMOTIONAL, ELLEMOTION, AGENT ELLEMOTION, PORT2U, PORT2U.AU, ELLEMOTIONINDUSTRIES.AI, and all associated logos, stylisations, and brand assets.

2. Permitted Use

You may use our trade marks only to: accurately identify our websites or Emotional Mail as the source of products or services you have purchased; provide factual attribution in editorial or news content; or as expressly authorised by us in writing.

3. Prohibited Use

• Use our trade marks as or as part of your own business name, trading name, domain name, app name, or social media handle.
• Use our trade marks in a manner that suggests sponsorship, affiliation, or endorsement by us that does not exist.
• Modify, distort, or alter our trade marks in any way.
• Register any trade mark, business name, or domain that is identical or confusingly similar to our trade marks.

4. Trade Mark Infringement

Unauthorised use of our trade marks may constitute trade mark infringement under the Trade Marks Act 1995 (Cth) and may also constitute misleading and deceptive conduct under the Australian Consumer Law. We reserve the right to take all available legal action to protect our trade marks.
