AI and Provenance Statement

1. Who We Are

Emotional Mail (operated by Brent Bernard trading as ElleMotional, ABN 43 432 414 727, Gold Coast, Queensland, Australia) is a human-AI hybrid creative studio. Every product we sell is produced using generative AI tools under direct human direction, review, and final approval. A human being decides what is created, curates every output, edits and finalises every file, and approves every listing before it is published or sold. AI is our production tool. It does not make final creative or business decisions.

2. Full Disclosure: Everything You See Is AI-Generated

To be completely transparent: every character, figure, object, creature, scene, and depiction of a person shown in our artwork, product designs, and marketing — including anything that looks human — is entirely AI-generated and fictional. This includes characters, mascots, cartoon or animated figures, stylised creatures, and any imagery resembling animals, dinosaurs, eggs, or people. None of these depict a real, living person, a real animal, or any real entity. Any resemblance to an actual person is coincidental and unintended. We do not photograph, film, or use real human models, real photography of people, or likenesses of real individuals in our product artwork.

3. Our Service Model

We offer digital download products built using AI-generated artwork, design, text, and supporting formats. Whether you are purchasing a ready-made product or commissioning custom work, AI assistance is used somewhere in the production process, and a human reviews and finalises the result before delivery.

4. Why We Disclose This

We want anyone who views, purchases, or is told about our work to know clearly and in advance that we use AI to help us create, produce, and sell our products, and to help build and run this website. Transparency builds trust, and several jurisdictions where our customers live have introduced specific disclosure expectations for AI-assisted content.

5. Photorealistic Imagery and Deepfake Disclosure (EU Customers)

Under Article 50(4) of the EU AI Act (Regulation (EU) 2024/1689, transparency obligations effective 2 August 2026), where any of our artwork is photorealistic in style and depicts a plausible-looking person or place, we treat this as falling within that disclosure duty and label it as AI-generated at the point of sale.

6. California AI Transparency Act (CAITA / SB 942)

As a sole trader using third-party AI tools, we are not a covered provider under this law and have no direct watermarking obligation. Where the AI tools we use embed provenance data such as Content Credentials (C2PA) or SynthID in their output, we do not strip or remove that metadata.

7. Australian Consumer Law

Under the Australian Consumer Law (Competition and Consumer Act 2010, ss 18 and 29), all AI-assisted written content is reviewed by a human for accuracy before publication.

8. Content Provenance (C2PA / Content Credentials)

Where the AI tools we use attach Content Credentials or a similar verifiable watermark to generated files, we preserve that metadata through our production process wherever technically possible.

9. Internal Compliance Practice

We keep an internal record for each product covering the AI tool and model used, the nature of our creative input, whether the content is photorealistic or depicts a person, and where disclosure has been applied across each platform.
